TrackDowner respects the intellectual property rights of others and expects its users to do the same. We are committed to complying with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. This page outlines how copyright holders can report alleged infringement.

1. Important Notice

TrackDowner does not host, store, or upload any copyrighted audio files on its servers. Our service functions solely as a technical tool that processes publicly available URLs provided by users. We act as an intermediary and do not control, curate, or distribute any music content. All content accessed through our service remains on third-party servers.

2. No Storage of Copyrighted Material

We want to make it explicitly clear that:

  • We do not store any audio files, tracks, or copyrighted material on our servers.
  • We do not maintain a library, database, or cache of downloadable content.
  • We do not index, catalog, or organize copyrighted works.
  • All processing is done in real-time and nothing is retained after the session ends.
  • We act as a neutral technological tool, similar to a web browser or search engine.

3. User Responsibility

Users of TrackDowner are solely responsible for ensuring that their use of the service complies with all applicable copyright laws in their jurisdiction. TrackDowner is intended for downloading content that users have the legal right to access, including:

  • Content that is in the public domain
  • Content licensed under Creative Commons or similar open licenses
  • Content for which the user holds a valid license or subscription
  • Content used under fair use provisions (e.g., education, commentary, research)

4. Filing a DMCA Takedown Notice

If you are a copyright owner (or authorized agent) and believe that content accessible through our service infringes your copyright, you may submit a DMCA takedown notice. Please include:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, including the URL or other specific location.
  4. Your contact information (name, address, telephone number, and email).
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf.

We will review and respond to all valid DMCA notices within 48–72 business hours.

6. Counter-Notification

If you believe that material was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification in accordance with Section 512(g) of the DMCA. Counter-notifications must include the same contact and good-faith requirements listed above.

7. Repeat Infringers

In accordance with the DMCA, TrackDowner will, in appropriate circumstances, disable and/or terminate the accounts or access of users who are deemed to be repeat infringers.

8. Safe Harbor

TrackDowner operates under the safe harbor provisions of the DMCA (17 U.S.C. § 512). As a service provider, we do not have actual knowledge of infringing activity prior to receiving a valid DMCA notice. We act expeditiously to remove or disable access to allegedly infringing material upon receipt of proper notification.
